Prayer: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to forthwith consider and direct payment of belated payment interest on the petitioner's terminal benefits as submitted through working sheet along with the representations dated 04.01.2021 on merits and as per law.

ORDER

The petitioner has filed this writ petition for a Mandamus, to direct the first respondent to consider the interest to the petitioner on the belated payment of terminal benefits in terms of working sheet along with the representations dated 04.01.2021.

2. Though the petitioner has reached the age of superannuation on 31.07.2000, the petitioner was however not allowed to retire. Thereafter, a charge memo was issued on 27.04.2004 to the petitioner. The charges were later dropped by the respondents. Thereafter, another charge memo dated 03.02.2000 was issued. The charges against the petitioner were also dropped by the respondents.

3. Since the petitioner was not allowed to retire on the date of superannuation but was allowed to retire after the disciplinary proceedings came to an end and there has been delay in settlement of terminal benefits to the petitioner.

4. Appearing on behalf of the respondents, learned Government Advocate for the respondents submits that the respondents will pass appropriate orders.

5. Under these circumstances, the petitioner has sent representation dated 04.01.2021. The aforesaid representation of the petitioner has not evoked any response so far. Hence this writ petition.

6. Recording the same, the first respondent is directed to consider the representation dated 04.01.2021 of the petitioner and dispose the same within a period of eight weeks from the date of receipt of a copy of this order. The representation of the petitioner is only for interest on belated payments on the petitioner's terminal benefits.

7. This Writ Petition stands allowed with the above observations. No costs.
