ORDER : The Court Made the following order :- The petitioner who apprehend arrest at the hands of the respondent police for the alleged offence under Section 174(3) of Cr.P.C. altered to 304-B of IPC in Cr.No.140 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner is alleged to have harassed his wife demanding dowry, due to which, she committed suicide.

3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and that he has been falsely implicated in this case. The learned counsel further submitted that the petitioner has to take care of his 1-1/2 years old female child.

4.The learned Government Advocate (Crl. Side) submitted that investigation reveals that the petitioner has harassed his wife due to which she committed suicide and further submitted that the female child is now under the care and custody of the parents of the deceased. He further submitted that investigation is at the preliminary stage and that the custodial interrogation is necessary and vehemently opposed for grant of anticipatory bail to the petitioner.

5.Considering the allegations levelled against the petitioner and since investigation is at the preliminary stage, I am not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. -sd/- 24/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
