Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 19.04.2019 to appoint the petitioner to the post of Superintendent (Legal) / Senior Superintendent (Legal) as per the CSR (Common Service Rules) within stipulated time as may be fixed by this Hon'ble Court.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to consider the petitioner's representation dated 19.04.2019 to appoint the petitioner to the post of Superintendent (Legal) / Senior Superintendent (Legal) as per the CSR (Common Service Rules) within stipulated time as may be fixed by this Hon'ble Court.

2.Heard the arguments advanced on either side. 3.The case of the petitioner is that the petitioner joined service as Junior Assistant Trainee in the Dheeran Chinnamalai Transport Corporation, Trichy on 18.09.1987 and his service was regularized as Junior Assistnat with effect from 24.09.1988. Thereafter, the petitioner was posted as Assistant and Senior Assistant. The petitioner has completed B.L.Degree and has also completed Diploma in Labour Law. The next avenue of promotion available to the petitioner is Superintendent (Legal) / Senior Superintendent (Legal) as per the conditions stipulated in Common Service Rules. In this regard, the petitioner made representation dated 19.04.2019 to the respondents, however, the same has not yet been considered. Hence, this petition. 4.The learned counsel for the petitioner would submit that without going into the merits of the case, it would suffice, if this Court issues direction to the respondents to consider the petitioner's representation dated 19.04.2019 and to pass appropriate orders.

5.Considering the limited request made by the learned counsel appearing for the petitioner, I am inclined to issue direction to the respondents to consider the petitioner's representation dated 19.04.2019, on merits and in accordance with law and to pass appropriate orders, as expeditiously as possible.

6.The writ petition is accordingly disposed of. No costs. Consequently, the connected miscellaneous petition is also closed.
