Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the rejection order passed by the second respondent in Legal Heirs Certificate Online Application No.TN-7202601082438 Nil dated and quash the same and direct the second respondent to issue Legal Heirs Certificate to the petitioner.

By consent, the writ petition is taken up for final disposal at the admission stage itself.

2.The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus to call for the records pertaining to the rejection order passed by the second respondent in legal heirs certificate online application No.TN-7202601082438 Nil dated and quash the same and direct the second respondent to issue legal heirs certificate to the petitioner.

3.The learned counsel appearing for the petitioner submitted that one Arulmani Selvi is the first wife of the petitioner's father and out of the wedlock, they were blessed with three children namely, Akaneesri, Manikandan and Abinaya. The petitioner's father married the petitioner's mother namely, Theivamalar as his second wife and out of the wedlock, they were blessed with two children namely, Dhanushya/ petitioner and Bragadeeswaran and the petitioner's father Neelakandan died on 14.01.2023. Thereafter, the petitioner applied for legal heirs certificate through online on 08.01.2026 by including 2/6

the name of the first wife of the petitioner's father, their three children, the name of the petitioner and her brother and by excluding the name of the petitioner's mother, however, the said application was rejected stating inter alia that 'Based on RI report Deceased death address Thanjavur. On enquiry it has been found that deceased having two wife Other wife name is Theivamalar And She has two children Dhanushya and Bragadeeswaran Not Recommended'. The learned counsel further submitted that the second respondent ought to have considered the petitioner's application in terms of G.O.(Ms.) No.110, Revenue and Disaster Management, Revenue Administration Wing, RA-3(2) Section, dated 13.03.2024, however, rejected the petitioner's application, which is not sustainable one. 4.The learned Government Advocate appearing for the respondents submitted that this Court may set aside the rejection order and remand the matter back to the second respondent to consider the matter afresh strictly in terms of G.O.(Ms.) No.110, dated 13.03.2024.

5.Perusal of records disclose that one Arulmani Selvi is the first wife of the petitioner's father and out of the wedlock, they were 3/6

blessed with three children namely, Akaneesri, Manikandan and Abinaya. Petitioner's mother namely, Theivamalar is the second wife of the petitioner's father and out of the wedlock, they were blessed with two children namely, Dhanushya/ petitioner and Baradeeswaran and the petitioner's father Neelakandan died on 14.01.2023. Thereafter, the petitioner applied for legal heirs certificate through online on 08.01.2026 by including the names of the first wife of the petitioner's father, their three children, the petitioner and the petitioner's brother and by excluding the name of the petitioner's mother, however, the said application was rejected.

6.It is useful to extract hereunder the relevant portion of G.O.(Ms.) No.110, Revenue and Disaster Management, Revenue Administration Wing, RA-3(2) Section, dated 13.03.2024: "2.Legal Heirship (Relationship) Certificate shall be issued to the applicant(s) irrespective of the Religions / Gender, with the name of the following persons; their relationship with the deceased and their living status:

I.(A) In case of death of Married Person 4/6

i.Spouse(s) of the deceased (Mention the names of the spouses, if more than one spouse, if permissible under relevant personal Law) ii.Children / Legally adopted Children of the deceased iii.Parents of the deceased (C)In case of death of Un-Married Person i.Parents of the deceased ii.Siblings (Brothers and Sisters) of the deceased"

7.In view of the above, the impugned rejection order is set aside and the matter is remanded back to the second respondent. The second respondent shall consider the matter afresh and decide the issue strictly in terms of G.O.(Ms.) No.110, dated 13.03.2024. 8.The writ petition is disposed of. No costs.
