1.Heard the learned counsel for the petitioner. 2.The petitioner is the complainant in C.C.No.378 of 2013 on the file of the FTC-IV, Metropolitan Magistrate, George Town, Chennai. He filed a private complaint under Section 138 of Negotiable Instrument Act and in that case, even on 05.02.2104, the case was adjourned for defence witness as defendant did not examine any witness. On 20.02.2014, at request, the case was adjourned for further proceedings or settlement. It is also seen that the complainant was present on all the hearing whereas the respondent/accused was not present.
