PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent police not to harass the petitioner herein under the guise of investigation pertaining to the complaint pending on the file of Respondent Police.

ORDER

This petition has been filed to direct the respondent police not to harass the petitioner.

2. The contention of the petitioner is that he is a trader and a member of the Mayilai Traders Association. The Traders Association has lodged a false complaint as against the petitioner due to the business rivalry. Based on the same, the petitioner is constantly harassed by the respondent police under the guise of enquiry.

3. The learned Government Advocate (crl. side) would submit that the petitioner, a member of the said Mayilai Traders Association, has received a loan of Rs.3 lakhs. The said Association is run with the contribution of its members and for benefit of the traders. The petitioner failed to repay the loan amount and thereby bringing down the association's financial cycle to a grinding halt.

4. The learned counsel appearing for the petitioner, on instructions, would submit that the petitioner will appear before the respondent on 23.08.2021 without fail.

5. Recording the same, this Criminal Original Petition is disposed of.
