4. Selvi ..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing to dispose petitioner representation dated 10.11.2025 and consequently issue directions to remove the name of the 4th Respondent in Patta No.869. For Petitioner(s):

M/s.D.Bharathy For Respondent(s):

Mr.B.Pachaiyappan, Government's Counsel for R1 to 3

ORDER

This writ petition is filed to consider the petitioner's representation dated 10.11.2025.

2. Learned counsel for the petitioner would submit that the petitioner has made a representation dated 10.11.2025 before the respondent, seeking cancellation of patta, which was wrongly issued in favour of the fourth respondent in respect of petitioner's property. However, the said representation was not considered, as on date. Hence, this writ petition.

3. Mr.B.Pachaiyappan, learned Government's Counsel takes notice on behalf of respondents 1 to 3 and submitted that the power to cancel a patta is vested with the Revenue Divisional Officer (RDO). However, in the case on hand, the petitioner has sent a representation to the respondents herein, who lacks the competent authority to order such a cancellation.

4. Heard the learned counsel on either side and perused the materials available on record.

5. As rightly contended by the learned Government's Counsel, the Revenue Divisional Officer is the competent authority to cancel the patta.

Unless the petitioner makes a representation before the Revenue Divisional Officer, no order can be passed regarding the cancellation of the patta.

6. In such view of the matter, this writ petition stands dismissed with a liberty to the petitioner to make a fresh representation before the Revenue Divisional Officer, seeking cancellation of patta, which was wrongly issued in favour of the fourth respondent, within a period of eight weeks from the date of receipt of a copy of this order.

With the aforesaid observation and direction, this writ petition stands disposed of. No costs.
