ORDER
It is the contention of the petitioner that under the guise of enquiry, he was threatened and abused by the respondent Police to settle an undue demand made by the second and third respondents, thereby, causing harassment. Hence, he filed this Criminal Original Petition.
2. The learned Additional Public Prosecutor submitted that, even according to the petitioner, both the petitioner and the third respondent were engaged in iron scrap business. In connection with the Iron Scrap business, the third respondent had paid a sum of Rs.8,90,000/-, out of which, Rs.2,50,000/- has been repaid by the petitioner. For the balance amount, the petitioner had given an undertaking on 25.04.2026 to settle the amount by 30.05.2026. Contrary to the said undertaking, the petitioner has now filed the present petition alleging harassment. The letter of undertaking dated 25.04.2026 is extracted hereunder:
3. In reply, the learned counsel for the petitioner submitted that the petitioner acknowledges the liability of Rs.6,40,000/- and undertakes to repay the above. He has agreed to pay Rs.1,00,000/- by cheque on 20.05.2026 and the balance of Rs.5,40,000 by 30.05.2026.
4. Today, the learned counsel for the petitioner submitted that the amount of Rs.5,40,000/- shall be paid in two instalments of Rs.2,70,000/- (each). The first instalment of Rs.2,70,000/- on or before 30.05.2026 and the balance of Rs.2,70,000/- on or before 25.06.2026.
