O R D E R

This Criminal Original Petition has been filed seeking to quash the FIR registered in Crime No.642 of 2008 on the file of the first respondent, for the offences under Sections 147, 148 of IPC and Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act, 1992.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first respondent. Perused the materials available on record.

3. It is seen from the records that, based on the complaint lodged by the second respondent, the first respondent registered an FIR in Crime No.642 of 2008. It is alleged that there was a dispute between the groups of students of Dr.Ambedkar Law College, thereby caused damages to the college property. The occurrence had taken place on 12.11.2008 and the FIR was registered as Crime No.642 of 2008. Thereafter, there is absolutely no progress in the investigation so far. Merely keeping the FIR pending without any action would not serve any useful purpose. The first respondent also failed to explain for the

inordinate delay in completing the investigation. In fact, so far no investigation has been done and FIR itself has to be kept in a cold storage.

4. In view of the above, in order to ends of justice, this Court is of the opinion that the FIR in Crime No.642 of 2008 is liable to be quashed. Accordingly, the FIR is hereby quashed and the Criminal Original Petition stands allowed.

Consequently, connected miscellaneous petition is closed.
