[Order of the Court was made by S.S.SUNDAR, J.,] This Criminal Miscellaneous Petition is filed praying to suspend the sentence passed against the petitioner by the learned Sessions Judge, Fast Track Mahila Court, Krishnagiri in SC No.171/2019 dated 28.03.2023, pending disposal of Criminal Appeal and enlarge the petitioner on bail.

2. Learned counsel for the petitioner seeks permission of this Court to withdraw the Criminal Miscellaneous Petition and he has made an endorsement to that effect.

3. Recording the submission of the learned counsel for the petitioner and the endorsement so made, this Criminal Miscellaneous Petition is dismissed as withdrawn.

4. Further, it is pointed out by the learned counsel that all the other accused were acquitted.

5. Hence, Registry is directed to list the main appeal for final hearing during the 1st week of December 2023.
