Appeal against the order, dated 28.04.2010, passed in H.M.O.P.No.56 of 2007 on the file of Principal Sub Court, Kumbakonam.

JUDGMENT

The appellant-husband has filed a petition for divorce and custody of the child on the file of Principal Sub-Court, Kumbakonam. The said Court, while deciding the petition, has granted the relief of decree of divorce, but negatived the claim for custody of the child. Against the order of the trial Court in denying the custody of the child, the appellant has preferred this appeal.

2 When the matter is taken up for final disposal, Ms.V.C.Thaarini, learned counsel for the appellant would submit that the child was born in the year 1999 and has since attained majority and, therefore, nothing survives for consideration in this appeal.
