Mr.T.Arun Kumar Addl.Govt.Pleader for R1 to R4 Order (Order of the Court was made by S.M.Subramaniam J.) Learned counsel for the petitioner would submit that the authorities competent conducted survey and issued notice under TamilNadu Urban Local Bodies Act.

2. In view of the said submission, the respondents 1 to 4 are directed to continue the enforcement action and remove the encroachment by following the procedures as contemplated under the relevant provisions of the Act and Rules by affording opportunity to the alleged encroachers within a period of twelve weeks from the date of receipt of a copy of this order. In view of express bar under the Act, no Civil Suit is maintainable and the authorities may initiate appropriate action defending the suit, if any instituted. It is made clear that encroachments identified only in respect of Government lands alone

are to be removed. If any encroachment is identified in patta land, the parties may be relegated to approach the competent civil court of law.

3. With the above direction, the writ Petition stands disposed of. No costs.
