2. Ganesh T Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to call for the records pertaining to the Police Notice No.212/OUT/CCC/2019 dated 28.05.2019 issued by the 1st respondent to the petitioner and quash the same.

ORDER

This petition has been filed challenging the notice issued by the respondent police dated 28.05.2019.

2. The learned counsel for the petitioner submitted that the issue involved in this case does not fall within the jurisdiction of the police and already the petitioner has appeared on number of occasions and given his statements and also the relevant materials before the concerned authorities. https://hcservices.ecourts.gov.in/hcservices/

Now the respondent police is insisting on the appearance of the petitioner by issuing the summons.

3. The learned Additional Public Prosecutor, Pondicherry appearing on behalf of the respondent police submitted that the petitioner may be directed to give his statement along with all the other materials and thereafter the respondent police will proceed further in accordance with law.

4. This Court has carefully considered the submissions made on either side and also the materials placed on record.

5. This Court does not want to discuss on the jurisdiction question raised by the petitioner at this stage. The petitioner shall appear before the 1st respondent on 20.06.2019 at 11.00 a.m. and shall give his statement and also the relevant materials. It is made clear that the respondent police shall not call the petitioner repeatedly for this purpose and on the statement and the materials placed before the respondent police, the 1st respondent shall proceed further in accordance with law.

6. This Criminal Original Petition is disposed of with the above direction. Consequently, connected miscellaneous petition is closed.
