The Official Liquidator, High Court, Madras v. Nil

Comp.A.No.288 of 2020 in M.SUNDAR.J., Mr.Bavisetty Sridhar, learned 'Deputy Official Liquidator' ('Deputy OL' for the sake of brevity), who is before me in this virtual hearing seeks permission to withdraw captioned company application, but requests that the rights of the 'Official Liquidator attached to this Court' ('OL' for the sake of brevity) may please be preserved to take out a fresh application with the same prayer/similar prayer after necessary compliance.

2. To be noted, this request is made as Deputy OL submits that captioned application, which is inter alia under Section 481 of the 'Companies Act, 1956' ('said Act' for the sake of brevity) has inadvertently been moved before completion of procedure qua contributories. A company petition for winding up under said Act ultimately has to be carried to its logical end and therefore, the request to preserve the rights qua Section 481 of said Act is tenable, reasonable and deserves to be acceded to.

In the light of the narrative thus far, captioned application is dismissed as withdrawn albeit preserving the rights of the OL in the aforementioned manner.
