Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records of the Second Respondent with respect to impugned order in F.17089/KVDGQA/2018-2019/ dated 07.05.2019 passed by the Second Respondent and quash the same and consequently directing to the respondents to continue service of the Petitioner as per agreement of Service Contract for House Keeping dated 01.12.2018.

When it is pointed out by Mr. M. Vaidyanathan, Learned Standing Counsel, who has taken notice for the Respondents, on instructions, that the Petitioner has got an effective alternative remedy under clause 2.6.1 of the agreement dated 01.12.2018 between the Petitioner and the Second Respondent to refer the dispute raised in this Writ Petition before the Deputy Commissioner, Kendriya Vidyalaya Sangathan (HQ), Chennai, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to resort to the same and he has made an endorsement to that effect, which is recorded.

Accordingly, the Writ Petition is dismissed as withdrawn granting such liberty. It is needless to add here that if the Petitioner refers the dispute to the said authority, he shall after affording full opportunity of hearing to the parties concerned in consonance with the principles of natural justice consider all the contentions that are raised in such appeal and pass a reasoned order on merits in accordance with law and communicate the decision taken. It is expected that such exercise shall be expeditiously completed preferably within a period of one month from the date on which the Petitioner refers the dispute for redressal to the said authority. Consequently, connected Miscellaneous Petition is also closed. No costs.
