Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus, directing the respondents to issue allotment order of house site and patta in favour of the petitioners based on the representation dated 23.02.2017 and 01.07.2017 in the land comprised in Survey No.440/1B, 440/11 and 440/12 or any other place situated at A.Reddihalli Village, Dharmapuri Taluk and District forthwith. The petitioners have come up with the present writ petition for a mandamus directing the respondents to issue patta in respect of the land comprised in Survey No.440/1B, 440/11 and 440/12 situated at A.Reddihalli Village, Dharmapuri Taluk and District, in favour of the petitioners, based on their representations dated 23.02.2017 and 01.07.2017.
2. According to the petitioners they are belonging to Arunthathiyar Community [SC(A)] and they made representations dated 23.02.2017 and 01.07.2017 to the respondents for allotment of free house site and patta in their favour. Since there was no response, on the said representations, they filed the present writ petition.
3. The learned Special Government Pleader appearing for the respondents on instructions submitted that the petitioners have not produced the required documents and relevant informations to the respondents, so as to enable them to consider their representations, which has been stoutly refuted by the learned counsel for the petitioners.
4. Irrespective of the submissions made by the learned counsel on either side, this Court, without going into the merits of the case, directs the petitioners to submit all the required documents, with regard to their claim, along with a copy of this order to the respondents within a period of four weeks from the date of receipt of the same. On such submission, the respondents shall consider the same and pass appropriate orders on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioners within a period of six weeks therefrom.
5. With the above direction, the writ petition stands disposed of. No costs.
