2022-07-08Honourable Mr Justice N. Anand Venkatesh2 pages

W.M.P.Nos.18012, 18017 & 18020 of 2021 in W.P.Nos.1900, 1994 & 2349 of 2021 N.ANAND VENKATESH,J., All these petitions have been filed seeking for a clarification of the order passed by this Court in a batch of writ petitions in W.P.Nos.21440 of 2015 etc., batch, dated 19.02.2021. 2.The petitioners have sought for a clarification insofar as Paragraph No.37 (a) of the order on the ground that this Court had stipulated the fulfillment of the educational qualification and appointment in a sanctioned post within the cadre strength, to be satisfied by the petitioners at the time of their appointment. According to the petitioners, many employees who were appointed during the period between 08.07.1980 to 12.03.2001 did not get the time scale of payment at the time of appointment and they came within the cadre strength only during the course of employment. Therefore, according to the petitioners, they want a clarity to the effect that the fulfillment of the conditions under Paragraph No.37 (a) should be satisfied during the course of the employment instead of at the time of their appointment.

Giving any clarity as sought for by the petitioners at this stage will only cause more confusion and it will open flood gates. 4.In view of the above, there is no requirement to issue any clarity to the order passed by this Court in the batch of writ petitions and the directions issued in Paragraph No.37 of the order stands confirmed.

5.In view of the above, all these petitions are dismissed. 08.07.2022 ssr (1/2) W.M.P.Nos.18012, 18017 & 18020 of 2021 in W.P.Nos.1900, 1994 & 2349 of 2021 https://www.mhc.tn.gov.in/judis
