A.No.5443 of 2022 A.No.5443 of 2022 in O.P.No.336 of 2020 C.V.KARTHIKEYAN,J., The present application has been filed seeking a direction to restrict the relief sought in the Original Petition in O.P.No.336/2020, only with respect to the 2nd minor child namely Ardhra Sasikumar who was born on 19.12.2006.

2. The 1st child, Ashwin Sasikumar, who was born on 20.03.2003 has attained the age of majority. The Original Petition does not survive with respect to the 1st child.

3. The present application has been filed seeking to restrict the relief sought in the Original Petition only to the 2nd child who is still a minor. Though the learned counsel for the respondent sought time for filing counter, since the date of birth of the children cannot be denied or disputed and by any mathematical calculation, the 1st child has attained the age of majority, the Original Petition for guardianship will not survive as against the child who has attained the age of majority.

4. The application stands allowed.

5. The Original Petition is now restricted only with respect to the custody and guardianship of the 2nd child, who is still a minor. Necessary endorsement may be made by the Registry in the Original Petition.
