The 4th defendant in the suit, Marappan, was wrongly described as Mariappan in the certificate copy. Hence the learned counsel has taken necessary steps to carry out the amendment in the original record. An amended certificate copy has now been furnished, wherein the name of the 4th defendant/4th respondent is correctly mentioned as Marappan.
Therefore, the present petition has been filed seeking necessary amendment in the grounds of appeal to reflect the correct name.
2.Considering the facts of the case, the petition to amend the cause title and correct the name of the 4th respondent from Mariappan to Marappan is allowed.
3.Fresh notice to the 4th respondent/Marappan returnable in four weeks. Private notice is also permitted.
4.Post the matter after four weeks.
