Heard Mrs. R.Ramya, Learned Counsel for the Petitioner, Mr. C. Mohan, Learned Counsel for the First and Second Respondents and Mr. M.B.Raghavan, Learned Counsel for the Third Respondent and perused the materials placed on record, apart from the pleadings of the parties.
2.The grievance ventilated by the Petitioner in this Writ Petition is to re-validate the medical insurance policy taken by her from the Fourth Respondent with retrospective effect. It is informed that after the filing of the Writ Petition, the Petitioner had undergone certain treatments for which claims have arisen during the period for which re-validation of the medical insurance policy has been sought. That apart, the Petitioner has died on 17.11.2019 and her husband has been brought on record as a legal representative by order dated 12.04.2021 in W.M.P. No. 8988 of 2022 passed by the Court. Since further reliefs are sought and necessary pleadings have to be made in that regard, Learned Counsel for the Petitioner seeks permission of this Court to withdraw this Writ Petition with liberty to file a fresh Writ Petition by the legal heirs of the deceased Petitioner seeking comprehensive reliefs with necessary pleadings. She has also made an endorsement to that effect in the court record.
In fine, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
