.. Respondents Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the 1st respondent to consider the petitioner's representation dated 19.04.2017.
For Petitioner : Mr.I.Arockia Selvaraj For Respondents : Mr.E.Balamurugan Additional Government Pleader for R1 & R2
O R D E R
Mr.E.Balamurugan, learned Additional Government Pleader takes notice for the respondents 1 & 2. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for a Mandamus, directing the first respondent to consider her representation dated 19.04.2017 and pass orders on the same.
3. Heard the learned counsel for the petitioner.
4. It is seen that the petitioner has lent money, by way of private transaction, to the respondents 6 & 7, who are working as teachers at the third & fourth respondents Schools. It is further seen that the petitioner made a request to the respective Head Master and sought for recovery of money from the respondents 6 & 7 from the salary and pay the same to the petitioner.
When such request was not considered, the petitioner approached the first respondent and made the above representation dated 19.04.2017.
5. A perusal of the averments made by the petitioner in the affidavit filed in support of the writ petition as well as the representation made by her on 19.04.2017, would make it clear that the petitioner is trying to recover money from the respondents 6 & 7, by way of making representation to the Educational authorities, who have nothing to do with the private money transaction said to have taken place between the petitioner and the respondents 6 and 7. If the petitioner is having any legal claim against those respondents, it is for her to work out such remedy before the competent Civil Court by filing appropriate suit. Without doing so, making the present
representation before the Educational authorities is not a proper course of action. Therefore, I find no merits to entertain this writ petition. Accordingly, this writ petition is dismissed. No costs.
