Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for the records in pursuant to the impugned order of punishment of removal from service issued by the 3rd respondent in proceedings Na. Ka. No. C2/ 2914/ 2014 dated 21.9.2017 and quash the same and consequently direct the respondents to reinstate the petitioner with all consequential service and monetary benefits.

The petitioner herein is aggrieved against the punishment imposed upon the petitioner removing him from service, by the order passed by the third respondent dated 21.09.2017. As against the same, the petitioner has preferred an appeal before the second respondent, which is stated to be pending.

2. When the punishment order of the third respondent has already been challenged and is pending before the second respondent herein, it would not be appropriate to adjudicate the present writ petition simultaneously when the appeal is pending. However, if the second respondent is called upon to dispose of the appeal within a stipulated time, the ends of https://hcservices.ecourts.gov.in/hcservices/

justice could be secured.

3. In the light of the above observation, the second respondent is directed to dispose of the petitioner's appeal dated 30.10.2017 within a period of three months from the date of receipt of a copy of this order.

4. With the above direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
