Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus to direct the second respondent to transfer the investigation from 4th respondent to 3rd respondent and to supervise and monitor the investigation in Cr.No.80 of 2024 and direct the third respondent to file the final report forthwith. ORDER
This petition has been filed seeking directions to the second respondent to transfer the investigation from 4th respondent to 3rd respondent and to supervise and monitor the investigation in Cr.No.80 of 2024 and direct the third respondent to file the final report forthwith. According to learned counsel for the petitioner, the petitioner is running a jewellery shop in the name and style as "Akshay Jewel Craft" for the past 25 years. He has been making gold and cash 2/6
deposits with the seventh respondent for more than 13 years back and the seventh respondent illegally claimed that there was due and hence the petitioner sent legal notice on 24.07.2023 requesting him to produce statement of business transaction. Instead of giving reply to the notice sent by the petitioner, the seventh respondent has filed false complaint against the petitioner. After registering FIR against the petitioner, based on the complaint filed by the seventh respondent, the respondent police are acting as per the instructions of the seventh respondent. The petitioner wants fair investigation to be conducted. Therefore it is necessary to order transfer of investigation.
Learned Senior Counsel for the seventh respondent would submit that the petitioner instigating the other accused, had earlier tried to transfer the investigation registered against them based on the other complaint given by the seventh respondent, but, this Court refused to transfer. Now the petitioner has filed this petition seeking transfer of investigation without any valid reason.

Heard the learned counsel for the petitioner, learned Government Advocate (Crl.Side) for RR1 to 4 and the learned Senior Counsel for the seventh respondent and perused the materials available on record.
On a careful reading of the grounds taken by the petitioner seeking transfer of investigation, it reveal that the reasons stated by the petitioner are not sufficient to transfer the investigation. Therefore this Court is not inclined to transfer the investigation as prayed for by the petitioner.
Accordingly the present Writ Petition stands dismissed. However the fourth respondent is directed to expedite the investigation and file charge sheet before the Court concerned. 18.06.2025 cgi Speaking /Non-speaking order 4/6
