ORDER : The Court Made the following order :- The petitioner, who was arrested on 16.07.2021 and remanded to judicial custody for the offence under Section 399 IPC in Cr.No.298 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 15.07.2021 at about 15.30 hours, the respondent and their team were in regular watch near Kadambai Lake, the petitioner along with his friends, had roaming in a suspicious manner, hence they were rounded by the police and on enquiry, it was revealed that they planned to commit dacoity. Hence the accused were arrested by the respondent.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged offence and he has been falsely implicated in this case. Therefore, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submitted that there is one previous case of similar nature was pending against the petitioner and the investigation is pending.

5. Considering the fact of pendency of one previous case of similar nature, against the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

6. For the reasons aforesaid, this Criminal Original Petition is dismissed.
