This petition has been filed seeking to set aside the order dated 27.02.2020 dismissing the Second Appeal for default.
2. Mr.V.P.K.Gowtham, learned counsel for petitioner/appellant submitted that the above Second Appeal was dismissed on 27.02.2020 and even though the petitioner has given necessary instruction for taking steps to restore the second appeal, due to Covid pandemic, counsel on record unable to take steps for restoring the appeal within time. Hence, he has filed the above petition to restore the above S.A.
3. Mr. N.Manokaran, learned counsel for respondent appeared and raised strong objections in allowing the above petition.
4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit filed in support of the petition seeking to restore the Second Appeal, this Court is inclined to allow this petition and to restore the second appeal.
5. Post the matter on 26.07.2023.
