This petition has been filed consequent to the unfortunate death of the petitioner pending writ petition.

If the cause survives, then a right is available to the legal representatives to prosecute the writ petition further. In the affidavit filed in support of this petition, it had been stated that the writ petition had been filed questioning the acceptance of resignation and relieving the writ petitioner from service with retrospective effect by about five years. If the writ petitioner succeeds in this Court, monetary benefits would accrue naturally to the legal representatives who therefore have a right to prosecute the writ petition.

In view of that particular reasoning, this petition stands allowed.
