ORDER

This Criminal Original Petition has been filed to quash the FIR in Crime No.291 of 2020 on the file of the first respondent.

The case of the prosecution is that during the time of spreading of covid-19, the petitioner along with other persons waylaid the defacto complainant and gave a life threat to him 3.

The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Therefore, he sought for quashing the impugned proceedings. 4.

Per contra, the learned Government Advocate (Crl.Side) submitted that investigation in the aforesaid case is almost completed and the first respondent is to file final report.

Heard the learned counsel for the petitioner, the learned Government Advocate (Crl.side) for the first respondent and perused the materials available on record.

I will not fault the first respondent for having registered the impugned First Information Report. But no adverse consequence ensued. It is

seen that the Government has taken a policy decision not to pursue the cases registered in the wake of breach of lock down restrictions. In these circumstances, continuance of the impugned prosecution is unwarranted. 5.

Therefore, the impugned First Information Report in Crime No.291 of 2020 registered on the file of the first respondent is hereby quashed and the Criminal Original Petition stands allowed. Consequently, the connected miscellaneous petition is closed.
