CMP Nos.442, 443 and 444 of 2014 in S.A No.290 of 2005 G.K.ILANTHIRAIYAN,J.

These petitions have been filed to condone the delay of 552 days in filing the petition seeking to set aside the abatement caused due to the death of the 3rd respondent; to set aside the abatement caused due to the death of 3rd respondent namely John Basha and also to bring on record the following persons:

1.K.J.Habeeba, 2.Jahangir, 3.Jasmine, 4.Faridha Banu & 5.Irfana (4 & 5 are minors rep. by their Mother K.J.Habeeba) as Respondents 7 to 11 being the legal heirs of the deceased 3rd Respondent, in the above S.A.No.290 of 2005.

2. This Court is satisfied with the reasons stated in the affidavits along with the petitions.

3. Accordingly, these three Civil Miscellaneous Petitions are allowed and the Registry is directed to carry out the necessary amendment in the cause title of the second appeal.

4. Post the second appeal on 20.02.2020.
