PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, to strike off the plaint in O.S.No.941 of 2016 on the file of the Subordinate Court, Coimbatore District. For Petitioner : Mr.C.R.Prasanan

O R D E R

The learned counsel for the petitioner made an endorsement indicating that he is withdrawing the Civil Revision Petition with liberty to raise all the contentions raised in the CRP before the lower Court. Learned counsel further wanted a direction to the Trial Judge, to dispose of the application in I.A.No.762 of 2016, as expeditiously as possible.

2. Learned counsel submitted that he would file a counter positively by 29.09.2016 in the injunction application in I.A.No.762 of 2016.

3. In view of the aforesaid submission and endorsement so made, the learned Trial Judge is directed to post the injunction application in I.A.No.762 of 2016, initially on 29.09.2016 for

filing counter by the petitioners herein and then post the matter for hearing the parties on 03.10.2016.

4.It is needless to mention that I.A.No. 762 of 2016 shall be disposed of, on merits and in accordance with law, as expeditiously as possible and in any case on or before 07 October 2016.

5. This Civil Revision Petition is disposed of, with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
