Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus calling for the records relating to the impugned order dated 12.09.2024 on the file of the respondent herein sent through SMS, quash the same and consequently direct the respondent to grant Grama Natham Patta for the plot measuring 8 cents = 3312 square feet in old Grama Natham S.F.No.126/1, New Grama Natham S.F.No.291/11 situate at Pulipakkam Village, Chengalpattu Taluk & District within a stipulated period.

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed challenging the impugned order dated 12.09.2024 passed by the respondent herein sent through SMS, quash the same and consequently direct the respondent to grant Grama Natham Patta for the plot measuring 8 cents = 3312 square feet in old Grama Natham S.F.No.126/1, New Grama Natham S.F.No.291/11 situate at Pulipakkam Village, Chengalpattu Taluk & District within a stipulated period.

The learned counsel for the petitioner would submit that the impugned order is a non speaking order, wherein, the petitioner's request for granting Grama Natham Patta was rejected without assigning any reason and was intimated to the petitioner through SMS. Hence, the present writ petition is filed.

3. Mr.A.Selvendran, learned Spl. Govt. Pleader who takes notice for the respondent would submit that the matter may be remitted back to the respondent who would re-consider the request of the petitioner and pass orders afresh.

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the respondent to re-consider the request of the petitioner seeking gramanatham patta in respect of the subject property after affording an opportunity of personal hearing to the petitioner and any other interested parties including rival claimants, if any, and pass orders on the same afresh within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.

5. With the above direction, this writ petition is disposed of. No
