ORDER

(The case has been heard through video conference) The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1) (aa), 4 (1-A) and 14A of the Tamil Nadu Prohibition Act, in Crime No.392 of 2020, on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that on 29.04.2020, the petitioners were illegally transported 60 litres of ID arrack. Hence, the complaint.

3. The learned Counsel for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution and a false case has been foisted against them. Hence, he prays for grant of Anticipatory Bail to the petitioners.

4. The learned Additional Public Prosecutor would submit that the petitioners were illegally found in possession of 60 litres of ID arrack. He would further submit that there are four previous cases pending as against the petitioners. Hence, he opposed for grant of anticipatory bail to the petitioners.

5. Taking into consideration of the facts and circumstances of the case and also the fact that there are four previous cases as againt the petitioners, this Court is not inclined to grant Anticipatory Bail to the petitioners.
