This application has been filed seeking to implead the proposed party as 3rd defendant in the suit on the ground that he has been appointed as Interim Resolution Professional of the 1st defendant Company by the National Company Law Tribunal.

2.Heard Mr.K.Ashok Kumar, learned counsel for the applicant and Mr.Prasanna Venkat, learned counsel for the respondents. Mr.Prasanna Venkat would submit that he had entered appearance for the proposed party. 3.Considering the fact that the 1st defendant is a limited Company, the 3rd defendant who has been appointed as Interim Resolution Professional to carry out the process of winding up of the Company need not be impleaded in his personal capacity. It is enough that he is permitted to represent the 1st defendant Company in his capacity as the Interim Resolution Professional appointed by the National Company Law Tribunal. R.SUBRAMANIAN, J.

A.No.2932 of 2021 in C.S.No.873 of 1998 KKN 4.In view of the same, this application is treated as an application seeking amendment of the short and long cause title in the suit and the same is allowed. The short and long cause title in the suit are permitted to be amended as follows:- "M/s.Ultra Tiles Pvt. Ltd., 26, 11th Avenue, Ashok Nagar, Chennai - 600 083, represented by Mr.Lingumgunta Venkata Shyam Sundar, Interim Resolution Professional, No.17, 3rd Floor, Gandhi Road, Alwarthirunagar, Chennai - 600 087."

The long cause title of the plaint shall also be accordingly, amended. The learned counsel for the plaintiff to carry out the amendment and file amended copy of the plaint by 11.11.2021.
