This original petition has been filed by the petitioners taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate relating to the securities held by their mother, Siva Prakasam Susheela @ Susheela Sivaprakasam, who died interstate on 01.01.1996. The father of the petitioners had predeceased their mother and died on 26.01.1979. The petitioners are the only legal heirs. In the year 2017, the company / Procter & Gamble Hygiene and Health Care Limited had issued a letter, which was computer generated, informing the petitioners about the holding of the shares mentioned in the schedule to the petition. 2.Paper publication had been effected. The 2nd petitioner was examined as PW-1. The letter issued by the company dated 29.03.2017 was marked as Ex.P1. The death certificate of the mother was marked as Ex.P2. The death certificate of the father was marked as Ex.P3. The copy of the legal heirship certificate was marked as Ex.P5.

smv 3.In view of the evidence adduced, this Original Petition stands allowed. The Succession Certificate is to be issued in the name of the 2nd petitioner, Rajendra Mudaliar.
