Respondent(s) This writ petition filed under Article 226 of the Constitution of India to issue a writ of Certiorarified Mandamus to call for the records pertaining to the Letter No. 426/WA4/TNSTC(V)/2026 dated 02.04.2026 in respect of 5th Petitioner and in Letter No. 11544/Settle3/TNSTC(V)/KPM/2025 dated 09.01.2026 in respect of Petitioners at S1.Nos. 1 to 3,6,7,9,11,12,15 and 16 and also in Letter No. 490/L1/TNSTC(V)/CR/MACT/36960/2025 dated 06.02.2026 in respect of Petitioners at S1.Nos.4,8,10,13,14 and 17 issued by the second, third and fourth respondents respectively and to quash the same as illegal and Consequently direct the respondents to fix the pay structure of the Petitioners by adapting 2.
57 multiplier factor taking into account of 7th Pay Commission with effect from the date of their re-designation as Junior Engineer/Assistant Engineer and pay the consequential difference of Salary with 10 %interest per annum along with the terminal benefits in the light of the Order of Madurai Bench of this Honble Court in W.P.(MD) No. 3609 of 2020 dated 20.06.2023 confirmed by Hon'ble Division in W.A.(MD) No. 1099 of 2024 dated 04.07.2024 and further confirmed by the Hon'ble Supreme Court of India in SLP(C) No. 26264 of 2024 dated 11.11.2024.

ORDER
This writ petition has been filed seeking to quash the letters dated 02.04.2026, 09.01.2026, and 06.02.2026 issued by the respondents 2,3 and 4 and direct the respondents to fix the pay of the petitioners herein by adopting the 2.57 multiplier factor taking into account the 7th Pay Commission with effect from the date of their re-designation as Junior Engineer/Assistant Engineer and pay the consequential difference of salary with 10% per annum along with the terminal benefits in the light of the orders passed in W.P.(MD) No,3609 of 2020, W.A.(MD) No.1099 of 2024 and SLP(c) No.26264 of 2024 dated 11.11.2024.

The case of the petitioners is that they were originally appointed as Junior Tradesman in the respondent Transport Corporation and later, promoted as Foreman on obtaining the diploma qualification and some of them were subsequently promoted as "General Foreman". Pursuant to the Government order dated 29.02.2016, the posts of Foreman and General Foreman were redesignated as Junior Engineer and Assistant Engineer respectively, and the incumbents were brought out of the ambit of the 12(3) Wage Settlement. While implementing the Tamil Nadu Revised Pay Rules 2017, the Government adopted a fitment factor of 2.57 for Government employees. However, the
petitioners' pay was fixed using a lower multiplier of 2.44 on the assumption that they had already received the benefit of the 2016 12(3) Wage Settlement. 2.(i). The petitioners were, in fact, excluded from the said settlement and are, therefore, entitled to pay fixation with the 2.57 fitment factor. In an earlier case involving similarly placed employees, the Madurai Bench of this Court directed application of the 2.57 multiplier, which was subsequently confirmed by the Division Bench and the Special Leave Petition filed before the Hon'ble Supreme Court was dismissed. Relying on these precedents, the petitioners seek similar relief and revision of their pay by applying the fitment factor of 2.57 instead of 2.44.
2.(ii). Therefore, the petitioners herein, who are also similarly placed persons, had submitted their representations to the respondents seeking consideration of their pay by adopting 2.57 multiplier / matrix. The respondents, by way of the impugned communications dated 09.01.2026, 06.02.2026, 02.04.2026, ejected their request stating that since they had already benefitted by the 13th wage settlement, their request to fix the pay by adopting the multiplier 2.57 could not be considered . Aggrieved by the same, the present writ petition has been filed.
3. Heard the learned counsel appearing on either side and perused the materials available on records.
4. Considering the fact that subject matter is no longer res integra, this writ petition is allowed and the impugned communications are quashed. The respondents are directed to consider the representations of the petitioners in the light of the orders of the Hon'ble Division Bench in W.A.(MD) No.1099 of 2024, which was further confirmed by the Hon'ble Supreme Court in SLP(C) No.26264 of 2024 dated 11.11.2024, and pass orders within a period of eight(8) weeks from the date of receipt of a copy of this order.
