(The case has been heard through video conference) Affidavit filed in support of this petition perused. The sole appellant died on 27.08.2020. The application to set aside the abatement and to bring legal representatives of the sole appellant filed on 08.10.2020 well within the limitation period. The petitioners are son, daughter and wife of the deceased R.Durai.

2. Taking note of the fact that they are the 1st class heirs of the deceased sole appellant and there is no other contra claim.

3. Hence the application is allowed and the petitioners are permitted to get implead as appellants 2 to 4.
