Respondent(s) PRAYER: This writ petition has been filed under Article 226 of the Constitution of India for issuing a writ of mandamus directing the respondent to pay the petitioner the difference/arrears of wages for the period from 01.09.16 to 31.07.17 and also terminal benefits namely Gratuity and Encashment of Leave, as admitted by the Respondent in the RTI information dated 14.03.25 after having revised the same based on the scale of the pay payable to him on the month of his retirement, together with 18 %interest per annum, within a time frame as may be fixed by this Honble Court For Petitioner(s):

ORDER

The instant writ petition has been filed with a prayer for issuing a writ of mandamus to direct the respondent to pay the arrears of wages for the period from 01.09.2016 to 31.07.2017 and also terminal benefits as admitted by the respondent in the RTI information dated 14.03.2025 based on the scale of pay payable to him together with 18% interest per annum.

2. The learned counsel for the petitioner would submit that the petitioner was appointed as a conductor in the respondent corporation. After completion of 30 years of service, he retired from service on 31.07.2017 on attaining the age of superannuation. Though the petitioner is entitled for wages, according to the wage settlement, he was not paid increase in his wage in accordance with the wage settlement. In this connection, the petitioner had sent representation on 13.03.2025.

3.The learned counsel for the petitioner would also invite the attention of this Court about the reply given by the respondent to the petitioner's RTI query, vide their reply dated 14.03.2025 stating that the employees are entitled basic pay of Rs.42,100/- in view of the wage settlement deed dated 01.09.2016. 2/4

4.At this juncture, the learned counsel for the respondent would submit that they would pay the petitioner's eligible amount in accordance with their service register within the period of six weeks from the date of receipt of a copy of this order with applicable interest at the rate of 6% per annum from the date of retirement till the date of disbursal.

5.In view of the above submission, this court deems it appropriate to direct the respondent to settle the petitioner's entitlement as agreed in accordance with their service register within a period of six weeks.. Accordingly, the writ petition is disposed of.
