ORDER

This petition has been filed to direct the respondent police to register a case based on the petitioner's complaint dated 29.09.2014 and to investigate the same and file final report.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. It is seen that a motor vehicle accident took place on 12.09.2014, in which this petitioner and the counter petitioner were injured. On the complaint dated 13.09.2014 lodged by one Manimaran, the respondent police registered a case in Cr.No.538 of 2014 under Sections 279 and 337 IPC against this petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The learned counsel for the petitioner submits that the

petitioner was hospitalised immediately after the incident, and only after he recovered, he came to know that he has been shown as an accused and Manimaran has been shown as the complainant. Hence, the petitioner has given the present complaint dated 29.09.2014. In respect of one incident, there cannot be two FIRs. Hence, this Court cannot direct the police to register a second FIR based on the complaint dated 29.09.2014. However, it is left open to the petitioner to workout his remedy in the manner known to law.
