Criminal Original Petition filed under Section 482 Cr.P.C. praying to call for the records in respect of the order dated 11.12.2012 passed in CRP.No.7 of 2012 on the file of the II Additional District and Sessions Judge, Salem confirming the order dated 08.02.2012 passed in CMP.No.6416 of 2011 in CC.No.138 of 2011 on the file of the learned Judicial Magistrate-IV, Salem and set aside the same by allow the above Criminal Original Petition.

ORDER

This petition is filed to call for the records in respect of the order dated 11.12.2012 passed in CRP.No.7 of 2012 on the file of the II Additional District and Sessions Judge, Salem confirming the order dated 08.02.2012 passed in CMP.No.6416 of 2011 in CC.No.138 of 2011 on the file of the learned Judicial Magistrate-IV, Salem and set aside the same.

2. It is seen that when the matter was posted on 16.04.2014 "For Admission", the learned counsel appearing for the petitioner took an adjournment and the matter was adjourned after one week. Thereafter, for the past five years, the learned counsel has not taken any steps to list the matter. Further it is pending for more than five years without even ordering notice. Now after the lapse of five years period, this petition cannot be considered and this Court is not inclined to entertain this petition.

3. In view of the above, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
