2. This application is wholly misconceived and unnecessary. The 6th respondent had become major even pending appeal before the lower appellate Court. Therefore, the second appeal was rightly showing the 6th respondent as major. All that required was to file an affidavit or any proof of the fact that the 6th respondent has now attained majority.
3. The learned counsel for the appellant was unwilling to do that. They instead succumbed to the pressure of the Registry which adopted a dogmatic approach and insisted upon the petitioner to file the application to declare the 6th respondent as major and discharge the guardian who was never appointed. This application is dismissed as unnecessary.
