The petitioner, who was arrested and remanded to judicial custody on 18.02.2025, for the offence under Sections 8(c),22(c) & 29(1) of NDPS Act, 1985 in Crime No.107 of 2025, registered on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner joined hands with other accused and were in possession of 55 grams of Methamphetamine. Hence, the respondent has register a case against the petitioner and other accused.
3.The learned counsel appearing for the petitioner submitted that the recovery is not from this petitioner and the contra band was recovered from the other co-accused. He further submitted that only based on the confession given by the co-accused, the petitioner has been implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the 2/4
prosecution case and states that the mandatory provisions has been complied with before arresting the petitioner. He further submitted that the petitioner has not been falsely implicated in this case as stated by the learned counsel for the petitioner and final report has been filed and the case is being numbered and taken on file.
6. In view of the above facts and the petitioner has not satisfied twin conditions under section 37 of NDPS Act. Therefore, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition stands dismissed .
