Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the first respondent to relieve the petitioner from the post of Plot Watcher (Supernumerary) so as to enable him to join the promoted post of Forest Watcher pursuant to the order of appointment vide proceedings in Pa.Aa.No.55/2014/P2 dated 21.08.2014 by considering his representation dated 16.05.2017. ORDER

The petitioner was promoted as Forest Watcher from the post of Plot Watcher (supernumerary) by order dated 21.8.2014 passed by the District Forest Officer, Thiruvannamalai North Division, Polur. However, the order of promotion has not been acted upon.

2. The learned Additional Government Pleader for the respondents submitted that in view of registration of a criminal case against the petitioner, he was not given promotion, in spite of the order having been passed on 21.8.2014. However, he has agreed that even the criminal case also has been decided in December, 2016 and the subsequent representation given by the petitioner is pending consideration.

3. When the criminal case also came to be decided in favour of the petitioner in the month of December, 2016, the respondents are directed to act on the promotion order dated 21.8.2014 and pay the salary with all consequential benefits to the petitioner, within a period of four weeks from the date of receipt of a copy of this order. With this direction, the writ petition stands allowed. No costs.
