This Civil Miscellaneous Application has been filed by the respondents to fix an early date for hearing the Second Appeal. However, in the main appeal the learned counsel for the appellants have been taking time.

2.A verification of the records, show that the matter was posted even in the year 2012 and the learned counsel for the appellants took time. Again, when it was posted in the year 2013. Again, the learned counsel for the appellants took time, infact to pay batta. Thereafter, when it was listed on subsequent dates, the appellants took time. Even on the last hearing date, the appellants were directed to issue notice to the newly impleaded 8, 9, 10 respondents.
