Criminal Original Petition filed under Section 482 Cr.P.C. praying to call for the records pertaining to the case in C.C.No.107 of 2013 on the file of the Judicial Magistrate Court No.IV, Coimbatore & District and quash the same as far as the petitioner is concerned.

ORDER

This Criminal Original Petition has been filed to quash the proceedings in C.C.No.107 of 2013 on the file of the learned Judicial Magistrate Court No.IV, Coimbatore District, having been taken cognizance for the offences punishable under Section 17 of TNK (RT) Order 1973 r/w 7(1) (a) (ii) of Essential Commodities Act @ Sec.17 of TNK (RT) Order 2000 r/w 7(1) (a) (ii) of Essential Commodities Act, 1955.

2. The learned Additional Public Prosecutor would submit that the case in C.C.No.107 of 2013 on the file of the learned Judicial Magistrate-IV, Coimbatore has been subsequently transferred to the file of learned Judicial Magistrate-II, Tiruppur and renumbered as C.C.No.225 of 2018. He further submitted that trial has also been commenced and 13 witnesses https://hcservices.ecourts.gov.in/hcservices/

have already been examined.

3. It is seen that the case in C.C.No.107 of 2013 on the file of the learned Judicial Magistrate-IV, Coimbatore has been subsequently transferred to the file of learned Judicial Magistrate-II, Tiruppur and renumbered as C.C.No.225 of 2018, and the trial commenced. At this stage, the proceedings cannot be quashed.

4. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
