The petitioner, who was arrested and remanded to judicial custody on 23.03.2024, for the offence punishable under Sections 174 of Cr.P.C. thereafter altered to Section 302 of IPC in connection with Sessions Case No.271 of 2024 1/4
on the file of the I Additional District Judge, Coimabtore.
2. The case of the prosecution is that petitioner was remanded on 23.03.2024 for the aforesaid offences, based on the NBW issued against him. The petitioner was continuously absenting himself from the committal proceedings. Hence, the case.
3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Crl. Side) strongly opposed for grant of bail to the petitioner stating that since the petitioner has been absenting himself during the committal proceedings the trial proceedings has not been completed and almost all the witnesses have been examined. The case is now posted on 05.08.2025 and the trial proceedings is in advanced stage.
5. Considering the fact that the trial was almost completed and also that the 2/4
trial itself will get completed within a short span, this Court is not inclined to grant bail to the petitioner.
