Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus, directing the respondents to consider the representation of the petitioner dated 04.03.2024 petitioner's wife dated 17.03.2025 in order to survey the land and fix the boundaries for the land situated in the Survey Nos.211/1 and 211/3 at Villupuram District, Vanoor Taluk, Peravur Village, Ulagapuram Post with an extent of 2 Acres and 75 cents (out of a total area of 2 hectares and 16.50 ares) and registered under Joint patta No.698.

ORDER

By consent of both parties, the present writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed seeking a writ of mandamus to direct the respondents to consider the representation of the petitioner dated 04.03.2024 and of the petitioner's wife dated 17.03.2025 in order to survey the land and fix the boundaries for the land situated in the Survey Nos.211/1 and 211/3 at Villupuram District, Vanoor Taluk, Peravur Village, Ulagapuram Post with an extent of 2 acres and 75 cents (out of a total area of 2 hectares and 16.50 ares) and registered under Joint patta No.698.

It was submitted by the learned Special Government Pleader for the respondents that the petitioner had paid the appropriate survey fee only with reference to the land in Survey No.211/3 and that the said land would be surveyed and a report would be submitted within a period of eight weeks from today. With regard to the land in Survey No.211/1, it is submitted that it is always open to the petitioner to submit an application along with appropriate survey fee. If any such application is made and if the Page No.2 of 6

same is in order, survey would be carried out within a period of eight weeks thereon.

4. The same stands agreed to by the learned counsel appearing for the petitioner.

5. In view thereof, the writ petition stands disposed of with the direction to the respondents to carry out a survey, place boundary stones and complete the process within a period of 8 weeks from the date of receipt of a copy of this order after giving prior notice to the petitioner, adjacent land owners and other interested parties including rival claimants, if any, with regard to the land in Survey No.211/3.

6. In so far as the land in Survey No.211/1 is concerned, if the petitioner makes an application, along with appropriate survey fee, the said land shall also be surveyed within a period of 8 weeks from the date of receipt of a copy of this order after giving prior notice to the petitioner, adjacent land owners and other interested parties including rival claimants if any.

It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.
