Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 3 to consider his representation of the petitioner dated 28.08.2019 and consequently direct the respondents 1 to 3 to take action on the fourth respondent within the time stipulated by this Court.

ORDER

With the consent of learned counsel on either side, this writ petition is taken up for final disposal at the admission stage itself.

2.The Writ Petition is filed seeking a mandamus to direct the respondents 1 to 3 to consider the representation of the petitioner dated 28.08.2019 and consequently to take action against the fourth respondent within the time stipulated by this Court.

3.It is the case of the petitioner that he belongs to Vedhapuram Village, Vengathangudi Panchayat. Due to theft of sand from the river and other areas, the petitioner made certain complaints to the authorities in the general welfare of the society. Despite the complaints, the fourth respondent did not take any action. The grievance of the petitioner is that on 27.08.2020 at about 8.00p.m, he was assaulted by the relatives of the fourth respondent and that the men of the fourth respondent took away his cell phone worth about Rs.20,000/-. Due to the same, the petitioner took treatment at the hospital and now, he discharged from the hospital. In this regard, the petitioner made a detailed representation to the respondents 1 to 3 on 28.08.2020. Since no action has been taken by the respondents, the petitioner is before this Court. 4.

Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 to 3 and perused the materials available on record. 5.Considering the facts and circumstances of the case and the submissions made on either side, this Court, without expressing any opinion on the merits of the case, directs the second respondent to consider the representation of the petitioner dated 28.08.2019, enquire into the same and pass appropriate orders, on merits and in accordance with law, after issuing notice to the petitioner as well as the fourth respondent and by affording them an opportunity of personal hearing or virtual hearing and after verifying the relevant documents, within a period of six weeks from the date of receipt of a copy of this order.

6.With the above directions, the Writ Petition is disposed of. No costs.
