Prayer :

This Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 9 to remove the entry "road" in the revenue records pertaining to the petitioners property situate in Old S.No.30/7, Old S.No.376/1A1B, New No.173 S.No.376/1A1A1, Block 26, Ward I, TS No.30/7 at admeasuring an extent of 51⁄2 cents in Selaiyur Village, Tambaram Taluk, Chengalpet District (Previously Kanchipuram District) and restore the petitioner's land as patta land.

ORDER

This Writ Petition has been filed for the issue of Writ of Mandamus directing the respondents to act upon the representation made by the petitioner, wherein the petitioner is seeking for removal of entry "road" in the revenue records with respect to the subject property and to be replaced with the name of the petitioner.

2. Mr.M.Mani Gopi, learned Government Advocate appearing on behalf of the respondents submitted that the 9th respondent viz., the Tahsildar, who is also incharge of the office of the 8th respondent has fixed the date for enquiry on 29.10.2020 at 11.00 a.m. and the petitioner can be present at the time of enquiry along with all relevant documents. The learned Government Advocate further submitted that the report will be submitted before the 2nd respondent and the 3rd respondent to pass the final orders.

3.Taking into consideration the facts and circumstances of the case and also of the fact that the petitioner has already been called for an enquiry, there shall be a direction to the 9th respondent to conduct the enquiry and the 8th respondent shall submit the report before the second respondent within a period of six weeks from the date of receipt of copy of this order. The second respondent on receipt of the report shall pass final orders strictly in accordance with law, within a period of six weeks thereafter.

4.This writ petition is disposed of with the above directions. No costs.
