Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus directing the 2nd respondent to shift the in Electric Pole in end of the street which was installed in front of the petitioner's house situated at No.5/10, Periyar Nagar, 3rd Cross Street, Srinivas Nagar,Padi, Chennai - 600 050.

By consent, this Writ Petition is taken up for final disposal.

2. The petitioner is the owner of the property comprised in Survey No.5/10, Periyar Nagar, 3rd Cross Street, Srinivasa Nagar, Padi, Chennai - 600 050 and there is an electricity pole erected in front of the petitioner's house. Therefore, the petitioner made a representation to the respondent to remove the electric pole. By virtue of order dated 25.09.2013 in W.P.No.28419 of 2012, this court directed the petitioner to pay some amount for convering the existing line into LT UG line namely underground line. Accordingly, the amount was worked out and it was directed to be paid by the petitioner. The petitioner does not want to convert the existing line to LT UG line. before this court seeking a direction to the respondent to shift the electric pole in the end of the street which was installed in front of the petitioner's house.

3. Heard Mr.S.Ilamvaludhi, learned counsel for the petitioner and Mr.P.R.Dhilip kumar, learned counsel appearing for the respondent.

4. The petitioner has so far not given any representation however, it is seen that earlier, he has taken steps to convert the existing line into LT UG line. In view of the amount involved in converting the existing line, the petitioner has not proceeded with the matter and therefore the petitioner is directed to give a fresh representation to the respondents within a period of one week from the date of receipt of a copy of this order and on receipt of such representation, the second respondent is directed to consider the same and pass appropriate orders, on merits and in accordance with law, within a period of two weeks thereafter.

5. With the above direction, this Writ Petition is disposed of. No costs.
