2. Heard Mr.A.Thirumaran, learned counsel for the petitioner and Mr.Kumaran, learned counsel for the respondent.

3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

4. Registry is directed to number the Criminal Appeal, if the papers are otherwise in order and list the same for admission.
