Criminal Original Petition filed under Section 482 Cr.P.C. praying to transfer the Maintenance petition in M.C.No.168 of 2012 filed by the respondent pending before the learned Family court Coimbatore, to the learned Principal Judge Family Court Chennai, which could be tried together with O.P.No.738 of 2014.

ORDER

This petition has been filed to transfer the Maintenance petition in M.C.No.168 of 2012 filed by the respondent pending before the learned Family court Coimbatore, to the learned Principal Judge Family Court Chennai, which could be tried together with O.P.No.738 of 2014.

2. The learned counsel for the respondent would submit that the petitioner has filed this petition to transfer the Maintenance petition in M.C.No.168 of 2012 filed by the respondent pending before the learned Family court Coimbatore, to the file of the learned Principal Judge, Family Court, Chennai, and tie together with O.P.No.738 of 2014 for joint trial. But the said petition in MCOP.No.738 of 2014 was transferred to learned Family Court, Salem and renumbered as OP.No.307 of 2014, which was disposed of and divorce was also granted in favour of the husband / petitioner by order dated 11.12.2014.

3. In view of the submission of the learned counsel for the petitioner, the prayer sought for in this petition cannot be granted now. However, considering that the case in M.C.No.168 of 2012 is still pending from the year 2012, the learned Family Court, Coimbatore is directed to complete the trial within a period of three months from the date of receipt of a copy of this Order.

4. With the above direction, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petition is closed.
